OUR TERMS & CONDITIONS
Hamilton Instrument & Electrical Pty Ltd (“We/Us/Our”) provide the quotation for goods and/or services as provided overleaf (“Quote”) on the following terms and conditions:
1. Quotes
a) Quotes are valid for 14 days from the date issued.
b) We reserve the right to amend the Quote before commencing any work to take into account any rise or fall in the cost
of completing the Quote. We will notify you of any amendment as soon as practicable.
c) An indication in the Quote of the time frame for the provision of the goods and/or services is an estimate only and is not
a fixed time frame. Subject to any obligations in respect of consumer guarantees under the Australian Consumer Law, this
estimate is not binding upon us.
2. Payment and Title
a) A 10% deposit is required to be paid to Us prior to commencement of all jobs that exceed or will potentially exceed
$2,500.00 (excluding GST
b) We require payment of our tax invoice(s) is required within 30 days from date of invoice.
c) Without prejudice to other rights and remedies available to us, we reserve the right to charge interest at the rate of 1.5%
per day on any outstanding tax invoices.
d) Title to the goods shall remain with Us until payment in full has been received. If payment in full is not made on the
agreed date, We have the right, with or without prior notice, to recover possession of the whole or any part of the goods
(and you agree that We may enter any premises occupied by you to satisfy that purpose) without prejudice to other rights
and remedies.
3. Warranty and Indemnity
a) To the extent permitted by law and subject only to any exceptions contained in these conditions, We shall under no
circumstances be liable in any way whatsoever to you for any form of loss, damage or expenses sustained or incurred by
you or any other party in consequence of or resulting directly or indirectly out of the supply of the goods or services by Us,
the use or performance thereof, any breach by Us of any provision of any contract incorporating these terms and
conditions or the negligence of Us or Our servants or agents, and limits any liability it might nevertheless have to a
maximum amount being the invoiced price of the goods or services in question.
b) Any advice, recommendation, information, assistance or service given by Us in relation to goods sold or supplied or
their use or application is given in good faith and is believed to be accurate, appropriate and reliable at the time it is given,
but is provided without any warranty of accuracy, appropriateness or reliability and We do not accept any liability or
responsibility for any loss suffered from your reliance on such advice, recommendation, information, assistance or
service.
By accepting our services you agree to be bound by these terms and conditions.
